End User License Agreement (EULA)

The terms and conditions set forth in the End User License Agreement ("Agreement", "EULA") constitute a legal agreement between The 3D Warehouse ("We", "Us", "Site") and you ("You", "Your"). Access to The3DWarehouse.com is subject to this End User License Agreement. If you access this site, you are agreeing to accept all terms and conditions set forth in this Agreement. If you do not agree to the Terms and Conditions, do not access this Site.


PRELIMINARY DEFINITIONS
  1. Content/Product is any material published at The 3D Warehouse, including but not limited to 3D Models, Blueprints, Materials / Shaders, Motion Capture, Scripts, Sound Effects / Music, Stock Photography / Images, Textures, and Tutorials.
  2. Member is anyone who creates a free account at The 3D Warehouse
  3. Seller is an individual or business who publishes Content at The 3D Warehouse

USE OF OUR SITE
  1. Use of the Site must be legal and ethical at all times.
  2. You consent not to copy, use, modify, distribute, exhibit, republish, transpose, or broadcast any Content or materials on this Site without written permission.
  3. Unauthorized use of any of the following is prohibited and may be prosecuted: intellectual property, marks, trade dress.
  4. The 3D Warehouse is a forum only. We admit zero liability for any Content and you are solely liable for all uploaded Content you place as a Member Seller or download as a Buyer.
  5. Any entity wishing to upload or download Content from The 3D Warehouse or use the blog feature is required to become a Member of the Site. There is no cost to Membership.
  6. You Agree to the Site Privacy Policy.
  7. The 3D Warehouse or any of it's Affiliates cannot be held liable for any damages caused by the use or performance of this Site, Content, linked websites, or other materials obtained though this Site. If you are aware of damages, you should discontinue your use of the Site.

MEMBER SELLERS
  1. You are strictly prohibited from including personal information in your uploaded Content or information relating to that Content.
  2. All uploaded Content must either be owned or have the right to use by the Member. The 3D Warehouse does not own uploaded Content by Members.
  3. You express that all uploaded Content and use of uploaded Content does not infringe upon the intellectual property of any other party except through their permission and/or release.
  4. Uploaded Content must not be defamatory, pornographic, obscene, incite minority/racial hatred, contain spam, viruses, malware, or anything that causes negative system/data interference.
  5. Member's files on The 3D Warehouse may not be used as a backup source.
  6. Downloads may occur only after Member Buyer(s) pay the price specified for the Content as well as agree to any terms and conditions attached to that Content, including this agreement.
  7. Responsibility of ensuring that their Site Member profile is up-to-date and accurate, allowing accurate information for payment, falls to each Member Seller. If the information is incorrect or inaccurate, payments may be delayed or you might not receive payments.
  8. The 3D Warehouse reserves the right to allow Members Buyers to download a product after it has been disabled and/or deleted from the Site by the Member Seller, in the event that the Member Buyer has purchased the Content prior to it having been disabled/deleted.

MEMBER BUYERS
  1. You must abide by the terms in this agreement, as well as any Member Sellers terms included in downloaded Content.
  2. Member Buyers do not own any of the Content they download. If any additional terms and conditions are contained in the Content, those terms and conditions apply to the downloaded Content.
  3. You may not use downloaded Content in a way that manner that destroys the integrity of any other group.
  4. You may not reverse engineer any Content.
  5. Certain Content requires additional rights, licensing, permissions, releases, clearance, etc. as they may contain third party copyrighted or trademarked information or content. The Member Buyer is solely responsible to determine wheter additional licensing, rights, permissions, releases, clearances, etc. are required before they download, purchase, or use the Content. The Member Buyer is responsible for additional licensing required if the intended use involves an area that could be considered sensitive, offensive, or immoral.
  6. Following your payment for the Content, you may use the Content as described below:
    • Your license to use the Content is not exclusive, others who purchase the Content have the right to use the Content.
    • Your license, upon purchase of the Content, is granted only to you as the Member Buyer.
  7. Content downloaded for free may not be used for commercial applications without written permission, it may only be used for personal non-commercial applications.
  8. Licenses are not valid for anyone other than the original Member Buyer and cannot be transferred under any circumstances. Content may not be sold, given as a gift, or assigned to any other person or entity in the form it is downloaded from the Site.
  9. If you use Content in software products, you are solely responsible for preventing users from gaining access to the Content.
  10. Content obtained by theft or fraud is not granted a license.
  11. The 3D Warehouse has the right to expire your download after (5) days. If you do not download the product within (5) days, and the product is expired, you must purchase the product again if you wish to use the Content.

GENERAL INFORMATION
  1. At any time, the 3D Warehouse has the right to monitor, edit, remove, etc. any Content for any reason, without notice.
  2. The 3D Warehouse may disable or delete a Member Account at any time, without any notice.
  3. Members agree to register using a valid email address.
  4. You are responsible for all activity that takes place under your Member Account. You are responsible for keeping your User ID and password confidential.
  5. Members are responsible for all of the content they enter into non-confidential sections of the Site, such as the Blog, and should not enter personal information. The 3D Warehouse is not responsible for content posted in such a format.
  6. The 3D Warehouse is not responsible for any delays in delivery or performance caused by circumstances beyond our control, such as due to the Internet or due to the Member's lack of providing proper information.
  7. Changes to the Agreement become effective for existing Members as soon as the update is published on the Site.
